Comments on: Διαγωνισμός Φωτογραφίας ‘ΘΕΣΣΑΛΟΝΙΚΗ 2012’ http://thess.gr/blog/1947 Η πύλη της Θεσσαλονίκης Thu, 03 Feb 2011 13:53:50 +0000 hourly 1 https://wordpress.org/?v=6.6.5 By: Θοδωρος http://thess.gr/blog/1947#comment-1716 Thu, 03 Feb 2011 13:53:50 +0000 http://thess.gr/blog/?p=1947#comment-1716 Συμφωνω απολυτα με τον προλαλησαντα, με καλυψε πληρως αναφορικα με τον ”διαγωνισμο” αυτον και χαιρομαι που δεν ειμαι ο μονος που βρισκει τους ορους αυτους προκλητικα αποτρεπτικους..(ακους εκει ουτε σε προσωπικη εκθεση!!)Κριμα πραγματικα γιατι μου αρεσει και το θεμα και η χρονικη συγκυρια κι εχω τεραστιο αρχειο απο φωτογραφιες στην πολη αυτην..Κριμα επισης γιατι αν και δεν ειχα καποια ιδιαιτερη εμπειρια απο τον Ιανο μετα απο αυτα επεσε στα ματια μου, γιατι μου φαινεται ολο αυτο ενας τροπος να μαζεψει σχεδον δωρεαν πολλες καλες φωτο και να τις εκμεταλλευτει εμπορικα.
Τις φωτο μου τις θεωρω παιδια μου και δε μπορω να τις αποχωριστω..

Χωρις να εχω τεραστια εμπειρια απο διαγωνισμους θεωρω απαραδεκτο να σου απαγορευουν ακομα και να εκθεσεις τις φωτο που ανεβαζεις στο διαγωνισμο..
Δυστυχως στα ματια μου φαινεται σαν ενας τροπος να μαζεψουν με ελαχιστο κοστος φωτογραφιες για τα λευκωματα τους και δεν ξερω τι αλλο.
Αν και μ ενδιεφερε πολυ το θεμα και αν κι εχω τεραστιο αρχειο απο φωτογραφιες της Θεσσαλονικης δε θα συμμετασχω στο ”διαγωνισμο” αυτον..

]]> By: Tertuliano Máximo Afonso http://thess.gr/blog/1947#comment-1698 Sun, 23 Jan 2011 15:13:01 +0000 http://thess.gr/blog/?p=1947#comment-1698 Άσχετα με το ποια είναι η άποψη του καθενός για τους διαγωνισμούς, ιδιαίτερο ενδιαφέρον στον συγκεκριμένο έχουν δύο παράγραφοι στους όρους αυτού, τις οποίες αν δεν την προσέξεις καλά και πάρεις μέρος (ενώ παράλληλα η συμμετοχή σου δεν σημαίνει ότι επιθυμείς και να χαρίσεις σε κάποιον άλλο την φωτογραφία σου), μάλλον την έχεις πατήσει…

Ο/Η φωτογράφος υποχρεούται να έχει τα πνευματικά δικαιώματα της φωτογραφίας που θα υποβάλει (να είναι δική του/της). Αυτόματα με την συμμετοχή στο διαγωνισμό, όλα τα περιουσιακά δικαιώματα της φωτογραφίας μεταβιβάζονται -για όσο καιρό διαρκεί η πνευματική ιδιοκτησία- στην ΙΑΝΟS Α.Ε και ως εκ τούτου η τελευταία ρητά αποκτά αποκλειστικό δικαίωμα για κάθε χρήση και δημοσίευση της φωτογραφίας (ιδίως έκδοση, πιθανές ανατυπώσεις και έκθεση φωτογραφίας).
Η ΙΑΝΟS Α.Ε έχει το δικαίωμα να χρησιμοποιήσει οποτεδήποτε και με οποιονδήποτε τρόπο επιθυμεί οποιαδήποτε από τις φωτογραφίες που θα υποβληθούν, με ονομαστική αναφορά στο φωτογράφο που έχει σχέση με τον παρόντα διαγωνισμό

Το οποίο σημαίνει ότι αν στείλεις φωτογραφία σου στον συγκεκριμένο διαγωνισμό, ξέχνα την ως δική σου (εκτός του γεγονότος ότι θα αναφέρεται το όνομά σου)! Δεν θα έχεις πια κανένα απολύτως δικαίωμα σε αυτήν, ούτε να την εκθέσεις, ούτε να την αναρτήσεις σε κάποιο site και ασφαλώς ούτε λόγος για να την πουλήσεις! Πολύ απλά γιατί δεν θα είναι δική σου! Και αυτό αφορά όχι μόνο αυτές που θα κερδίσουν κάποιο βραβείο (που και για αυτό ακόμα δεν θα υπήρχε λογική να συμβεί) αλλά για ΟΛΕΣ τις φωτογραφίες που θα πάρουν μέρος στον διαγωνισμό! Και ο Ιανός μετά από αυτό, άσχετα με το ποια είναι η αξία των φωτογραφιών, θα τις έχει στην ιδιοκτησία του για να τις κάνει ό,τι θέλει και να τις εμπορευθεί όπως αυτός νομίζει! Π.χ. για εξώφυλλα βιβλίων, ημερολόγια, και λοιπές εκδόσεις να τις πουλήσεις σε έντυπα, ακόμη και σε άλλους φορείς ή διοργανώσεις που έχουν ανάγκη φωτογραφιών της Θεσσαλονίκης (βλ. ΔΕΘ, συνέδρια κλπ.) χωρίς καμία άδεια και εννοείται αντίτιμο στον φωτογράφο. Και όχι μόνο κατά την διάρκεια του διαγωνισμού, αλλά ΓΙΑ ΠΑΝΤΑ (όσο καιρό διαρκεί η πνευματική ιδιοκτησία)!!!
Θα ήταν λοιπόν υπερβολικό να σκεφτεί κάποιος ότι ο ΙΑΝΟΣ διοργανώνει αυτόν τον διαγωνισμό, κυρίως, για να αποκτήσει μια συλλογή φωτογραφιών πάνω σε κάποιο συγκεκριμένο θέμα;

Λογικό είναι ένας διοργανωτής να έχει κάποια δικαιώματα πάνω στις φωτογραφίες που παίρνουν μέρος, όπως να τις χρησιμοποιήσει για να προβάλει τον διαγωνισμό, να κάνει μια έκθεση ή δεν ξέρω τι άλλο σαν προώθηση αυτού, όμως είναι η πρώτη φορά που βλέπω όρο σε κάποιο διαγωνισμό ο οποίος να λέει ότι με την συμμετοχή μιας φωτογραφίας ο διοργανωτής αποκτά όλα τα πνευματικά δικαιώματα της φωτογραφίας!

Είναι πολύ λυπηρό για μια τόσο σημαντική και επώνυμη εταιρία, όπως είναι ο ΙΑΝΟΣ, να διοργανώνει διαγωνισμούς με τέτοιους όρους. Θα πει κανείς, πολύ θεμιτά, ότι πριν από την ενδεχόμενη συμμετοχή σου πως θα πρέπει και εσύ να τους διαβάσεις ενδελεχώς και να τους κατανοήσεις. Πολύ σωστά και θα συμφωνήσω απόλυτα. Αυτό όμως θεωρώ ότι δεν αναιρεί σε κανένα βαθμό το είδος και το ήθος των προθέσεων του διοργανωτή…
